Najib sues Thomas, govt over ‘malicious prosecution’

KUALA LUMPUR: Najib Razak has filed a lawsuit against former attorney-general (AG) Tommy Thomas and the government for alleged misfeasance in public office by pressing 1MDB related charges against him.

The former prime minister claimed that the charges filed against him during Thomas’ tenure were “part of a long-planned, premeditated exercise”.

“This was also in line with the then (Pakatan Harapan) government’s plan.

“As an AG, he (Thomas) carried out his duties, at least in relation to the plaintiff (Najib), as if he was a ‘PH agent’,” Najib said in his statement of claim sighted by FMT. The suit was filed earlier this week.

Thomas was appointed AG on June 4, 2018 after Pakatan Harapan (PH) won the general election and formed the government with Dr Mahathir Mohamad again assuming the post of prime minister.

Najib further alleged that Thomas had in 2012 formed an opinion against him in relation to 1MDB.

“Thomas claimed he received sufficient anecdotal evidence that ‘a massive fraud had been perpetrated’.

“After the general election in May 2018, he (Thomas) had made up his mind to charge the plaintiff before studying the cases,” he said, pointing out that Thomas had formed a prejudiced mindset against him.

Najib also contended there was a meeting held between Thomas and Mahathir along with the inspector-general of police and the Malaysian Anti-Corruption Commission (MACC) officers in 2018.

“MACC repeatedly told Mahathir that they did not find any wrongdoing but Thomas proceeded to charge the plaintiff,” he said.

In July 2018, Najib was charged with abuse of power, criminal breach of trust (CBT), and money laundering involving RM42 million in SRC International Sdn Bhd funds in his bank accounts. He was convicted on seven charges and is awaiting a decision on the SRC International appeal.

Subsequently, in the same year, he was slapped with 25 counts of money laundering and abuse of power over alleged 1MDB funds in his bank accounts, as well as one count of allegedly tampering with the 1MDB audit report.

He was also jointly charged with former Treasury secretary-general Irwan Serigar Abdullah on six charges for misappropriating public funds to make payments to International Petroleum Investment Co (IPIC).

Najib claimed that Thomas, who was AG until Feb 28, 2020, had committed misfeasance in public office.

“The AG had prejudged the plaintiff’s cases before making a decision to charge the plaintiff as well as interfering with investigations,” he said.

Najib added that after Thomas left as AG, he used “inside knowledge of the prosecution and made disparaging remarks” despite the ongoing trials.

“As a former AG, he should not make sub judice comments that will influence the trials,” he said, making reference to Thomas’ biography “My Story: Justice in the Wilderness”.

Najib is also seeking RM1.94 million in damages.

The High Court fixed the case for mention on Nov 19.

Earlier this year, Najib’s lawyers issued a letter of demand against Thomas over the contents in the biography linking him to the death of Mongolian national Altantuya Shariibuu.
